Zesture Privacy Policy

The privacy of your data — and it is your data, not ours! — is a big deal to us. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information.
The application Zesture (hereinafter "App") and this website (hereinafter “Website”), together referred to as "Service" is provided by Tridev (hereinafter "Us", "We" or "Our").
Our Terms and Conditions (“Terms”) govern all use of our App and Website, and together with the Privacy Policy constitutes your agreement with us (“agreement”).
What information do we collect?
Personal Data
While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:
- Email address
- First name and last name
- Country
- Cookies and Usage Data
We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link.
Usage Data
We may also collect information that your browser sends whenever you visit our Service or when you access Service by or through any device (“Usage Data”).
When you access Service with a device, this Usage Data may include information such as the type of device you use, your device unique ID, the IP address of your device, your device operating system, unique device identifiers and other diagnostic data.
Cookies
We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information.
Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Other tracking technologies are also used such as tags and scripts to collect and track information and to improve and analyze our Service.

Google Analytics

The information generated by the cookie about your use of this Website (such as your IP address, the URL visited, the date and time the page was viewed) will be transmitted and stored by Google on servers in the United States. Google will use this information to monitor your use of this Website, compiling reports on website activity for website operators and providing other services related to website activity and internet usage. Google may transfer this information to third parties where required by law, or where such third parties process information on Google’s behalf. What information do we not collect?
The App requires access to your camera to allow our services to operate on your device. But we do not, however, collect from you any photos or other images through our App.
If your camera is fitted with light, the light will automatically be turned on as soon as you press the "Start Zesture" button. The App also sends you a notification (if notification permission is enabled) as soon as the camera turns on. You may deny the camera permission but the App will not be able to function in that case.
When you are using our App, the hand gestures detected from the camera are processed locally, on your own device. So, use of your camera is totally safe.
How and why is your information used?
We may use your information for a number of different purposes, which may include:
- creation of an account for your use of our Service
- providing you with the services, products or information you asked for
- processing orders that you have submitted
- carrying out our obligations under any contracts entered into between you and us
- keeping a record of your relationship with us
- conducting analysis and market research so we can understand how we can improve our services, products or information
- seeking your views or comments on the services we provide
- notifying you of changes to our services
- sending you communications which you have requested and that may be of interest to you. These may include information about campaigns, activities and promotions of goods and services
- we do not sell, rent or trade your personal information
How long is your information kept for?
We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.
We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.
How do we protect your information?
All data is encrypted via SSL/TLS when transmitted from our servers to your browser as well as from the App to our servers.
To protect your personal data from unauthorised access and abuse we have implemented technical and organisational security measures. We check these security measures regularly and adapt them, as necessary, to the state of technological progress.
Who has access to your information?
We do not sell or rent your information to third parties.

Law enforcement
We won’t hand your data over to law enforcement unless a court order says we have to. We flat-out reject requests from local and federal law enforcement when they seek data without a court order. And unless we're legally prevented from it, we’ll always inform you when such requests are made.
Deleted data
When you cancel your account, we'll ensure that nothing is stored on our servers past 30 days. Anything you delete on your account while it's active will also be purged within 30 days (up until then it's available in the trash can).
Location of Website and Data
Our Website is operated in the United States, from the Amazon Web Services us-east-1 region. If you are located in the European Union or elsewhere outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By using our services or providing us with your information, you consent to this transfer.
Payments
We may provide paid products within Service. In that case, we use third-party services for payment processing (e.g. payment processors).
We will not store or collect your payment card details. That information is provided directly to our payment processor Stripe, whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.
Your Data Protection Rights Under General Data Protection Regulation (GDPR)
You may have heard about the General Data Protection Regulation (“GDPR”) in Europe. GDPR gives people under its protection certain rights with respect to their personal information collected by us on the Website. Accordingly, we recognise and will comply with GDPR and those rights, except as limited by applicable law. The rights under GDPR include:
- Right of Access. This includes your right to access the personal information we gather about you, and your right to obtain information about the sharing, storage, security and processing of that information.
- Right to Correction. This is your right to request correction of your personal information.
- Right to Erasure. This is your right to request, subject to certain limitations under applicable law, that your personal information be erased from our possession (also known as the “Right to be forgotten”). However, if applicable law requires us to comply with your request to delete your information, fulfilment of your request may prevent you from using our services and may result in closing your account.
- Right to Complain. You have the right to make a complaint regarding our handling of your personal information with the appropriate supervisory authority.
- Right to Restrict Processing. This is your right to request restriction of how and why your personal information is used or processed.
- Right to Object. This is your right, in certain situations, to object to how or why your personal information is processed.
- Right to Portability. This is your right to receive the personal information we have about you and the right to transmit it to another party.
- Right to not be subject to Automated Decision-Making. This is your right to object and prevent any decision that could have a legal, or similarly significant, effect on you from being made solely based on automated processes. This right is limited, however, if the decision is necessary for performance of any contract between you and us, is allowed by applicable European law, or is based on your explicit consent.

Your Data Protection Rights under the California Privacy Protection Act (CalOPPA)
CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. The law’s reach stretches well beyond California to require a person or company in the United States (and conceivable the world) that operates websites collecting personally identifiable information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals with whom it is being shared, and to comply with this policy.
According to CalOPPA we agree to the following:
- users can visit our Site anonymously;
- our Privacy Policy link includes the word “Privacy Policy”, and can easily be found on the home page of our website;
- users will be notified of any privacy policy changes on our Privacy Policy Page;
- users are able to change their personal information by emailing us at [email protected].
Our Policy on “Do Not Track” Signals:
We honor Do Not Track signals and do not track, plant cookies, or use advertising when a Do Not Track browser mechanism is in place. Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.
You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.
Your Data Protection Rights under the California Consumer Privacy Act (CCPA)
If you are a California resident, you are entitled to learn what data we collect about you, ask to delete your data and not to sell (share) it. To exercise your data protection rights, you can make certain requests and ask us:
1. What personal information we have about you. If you make this request, we will return to you:
- The categories of personal information we have collected about you.
- The categories of sources from which we collect your personal information.
- The business or commercial purpose for collecting or selling your personal information.
- The categories of third parties with whom we share personal information.
- The specific pieces of personal information we have collected about you.
- A list of categories of personal information that we have sold, along with the category of any other company we sold it to. If we have not sold your personal information, we will inform you of that fact.
- A list of categories of personal information that we have disclosed for a business purpose, along with the category of any other company we shared it with.
Please note, you are entitled to ask us to provide you with this information up to two times in a rolling twelve-month period. When you make this request, the information provided may be limited to the personal information we collected about you in the previous 12 months.
2. To delete your personal information. If you make this request, we will delete the personal information we hold about you as of the date of your request from our records and direct any service providers to do the same. In some cases, deletion may be accomplished through de-identification of the information. If you choose to delete your personal information, you may not be able to use certain functions that require your personal information to operate.
3. To stop selling your personal information. We don’t sell or rent your personal information to any third parties for any purpose. We do not sell your personal information for monetary consideration. However, under some circumstances, a transfer of personal information to a third party, or within our family of companies, without monetary consideration may be considered a “sale” under California law. You are the only owner of your Personal Data and can request disclosure or deletion at any time.
Changes & questions
We may update this policy once in a blue moon — we’ll notify you about significant changes by emailing the account owner or by placing a prominent notice on our Website. You can access, change or delete your personal information at any time by contacting us.
